These Terms of Service (“Terms”) govern your access to and use of the website unlimitedwarmtransfers.com (the “Site”) and the lead-generation and warm-transfer services (the “Services”) provided by Amid Media LLC (“Amid Media,” “we,” “us,” or “our”), which operates Unlimited Warm Transfers. By accessing the Site or using the Services, you agree to these Terms. If you do not agree, do not use the Site or Services.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of a business, you represent that you are authorized to bind that business to these Terms.

2. The Services

Unlimited Warm Transfers provides marketing and lead-generation services in which we contact and pre-screen prospective homeowners and transfer qualified prospects to your business, generally by live phone transfer, for the industries and markets we make available. Service availability varies by industry and geographic market and is subject to capacity. Submitting a form or joining a waiting list does not create a contract or guarantee availability in your market.

3. Fees & Billing

Fees for the Services, including our flat monthly fee, are described during onboarding and in any separate service agreement you enter with us. Unless a separate written agreement states otherwise, fees are billed in advance, are non-refundable except as required by law, and may be updated on a going-forward basis with notice. Any specific pricing referenced on the Site is subject to change and to the terms of your service agreement.

4. No Guarantee of Results

Any performance figures, revenue numbers, results, testimonials, or case studies presented on the Site reflect historical performance across our client portfolio and are not a promise, projection, or guarantee of the results you will achieve. Outcomes depend on many factors outside our control, including your market, capacity, offer, pricing, responsiveness, sales process, and ad spend. You are solely responsible for your own business results.

5. Your Responsibilities

• Provide accurate, current, and complete information;
• Respond to transferred leads promptly and handle them in a lawful, professional manner;
• Comply with all applicable laws and regulations, including those governing telemarketing, consumer protection, licensing, and your trade;
• Maintain any licenses, insurance, and qualifications required to perform your services; and
• Not misuse the Site, interfere with its operation, attempt unauthorized access, or use it for any unlawful purpose.

6. Communications Consent

By providing your contact information, you consent to receive communications from us by email, phone, and text message as described in our Privacy Policy. You may opt out of marketing text messages by replying STOP. Message and data rates may apply.

7. Intellectual Property

The Site and its content—including text, graphics, logos, the Unlimited Warm Transfers and Amid Media names and marks, and the design and arrangement of the Site—are owned by or licensed to Amid Media and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

8. Third-Party Services & Links

The Site uses third-party services (for example, our CRM/forms provider and hosting) and may link to third-party websites. We do not control and are not responsible for the content, policies, or practices of third parties. We are an independent marketing company and are not affiliated with, or endorsed by, any advertising platform.

9. Disclaimers

THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AMID MEDIA AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Amid Media and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party, including in your handling of transferred leads.

12. Governing Law & Disputes

These Terms are governed by the laws of the United States and the state in which Amid Media LLC is organized, without regard to conflict-of-law principles. You agree that any dispute arising under these Terms will be resolved in the state or federal courts located in that state, and you consent to their jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site or Services after changes take effect constitutes acceptance of the updated Terms.
